Rhode Island Food Policy Council (“RIFPC”) reserves the right to change the terms, conditions, and notices under which the Site is available.

No Misrepresentation

You may make an account on this website, should the website provide such an option, but users are expressly prohibited from any form of fraud or misrepresentation in any way. The RIFPC reserves the sole right to terminate a user’s access and delete a user’s content for any reason, at the sole discretion of RIFPC. RIFPC is not responsible for the content of submissions by users.

No Infringement

You may not infringe on the intellectual property of any other person or entity through the use of the website. Any unauthorized use of any other person or entity’s intellectual property may result in the termination of the User’s account. You agree to indemnify, defend, and hold harmless RIFPC for your unauthorized use of any other person or entity’s intellectual property on the RIFPC website.

No Unauthorized Use or Access

You may not use any “deep-link”, “page-scrape”, “robot,” “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. RIFPC reserves the right to bar any such activity.

You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any RIFPC server, or to any of the services offered on or through the Site, by hacking, password “mining” or any other illegitimate means.

You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of RIFPC, including any RIFPC account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site.

You agree that You will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or RIFPC’s systems or networks, or any systems or networks connected to the Site or to RIFPC.

You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site.

You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal You send to RIFPC on or through the Site or any service offered on or through the Site. You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity.

You may not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of RIFPC or others. You agree to indemnify, defend, and hold harmless RIFPC to the greatest extent permitted under Rhode Island law, including attorney’s fees, for any illegal activity or activity that infringes on the rights of others.

All reproduced material requires a copyright notice in the form of “© [YEAR] Rhode Island Food Policy Council, All Rights Reserved” to be displayed on the relevant page(s). Assignment

The rights and obligations created for the User under this agreement may not be assigned to any other party.

Severance

In the event that one or more of the provisions of this agreement shall be found unenforceable, illegal or invalid, it shall not affect any other provisions of this agreement, and this agreement shall be construed as if the provision found to be unenforceable, illegal or invalid had never been contained in the agreement, or the unenforceable, illegal or invalid provision shall be construed, amended and/or reformed to be made enforceable, legal and valid.

Privacy Policy Generally

Rhode Island Food Policy Council (RIPFC) does not sell, rent or lease its customer lists to third parties. RIFPC may share data with trusted partners to help perform statistical analysis, send you email or postal mail or provide support to RIFPC. All such third parties are prohibited from using your personal information except to provide these services to RIFPC, and they are required to maintain the confidentiality of your information.

RIFPC may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on RIFPC or the site; (b) protect and defend the rights or property of RIFPC ; and/or (c) act under exigent circumstances to protect the personal safety of users of RIFPC or the public.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website. If you upload any images to the website, you represent and warrant that you are the copyright holder of the image, and you grant us an irrevocable license to use said image. You shall indemnify, defend, and hold harmless RIFPC from any claims by a third party of infringement of their intellectual property for your submission of any photos to the RIFPC website.

RIFPC may collect information about how Users use our Web site, for example, by tracking the number of unique views received by the pages of the Web site or the domains from which Users originate. We may use “cookies” to track how Users use our Web site. A cookie is a piece of software that a Web server can store on the Users’ PC and use to identify the User should they visit the Web site again. Third party partners

Some of the services we provide are facilitated by external partners – MailChimp for email marketing, Facebook, Google for Analytics, Calendly, Loomly and others. They need the the data so they can deliver their services either to RIFPC or on behalf of RIFPC or RIFPC’s affiliates. Each of these third party partners have their own privacy policies, accessible on their websites. Their privacy policies may differ from RIFPC’s.

Who we share your data with

If you request a password reset, your IP address will be included in the reset email. RIFPC may store and use your data for email, mail, or phone contact related to RIFPC’s activities, or activities of affiliates of RIPFC. If you would like to be removed from our database for these purposes, please email info@rifoodcouncil.org.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username) by emailing info@rifoodcouncil.org. Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Under the General Data Protection Regulation “GDPR” and the California Consumer Privacy Act (CCCPA) every User can request “to be forgotten”, meaning all their data must be deleted and never used again, except in certain circumstances, which may include having to keep processing your personal information to comply with a legal obligation. An example of such obligation is the requirement to keep a copy of all invoices to comply with financial and tax legislation. Visitor comments may be checked through an automated spam detection service. RIFPC may use your data for email, mail, or phone contact related to RIFPC’s activities, or activities of affiliates of RIPFC.

RIFPC will not discriminate against any web site user that exercises their rights under CCCPA, GDPR, or any other applicable internet privacy law.

Under 18 Users

In compliance with the Children’s Online Privacy Protection Act, RIFPC will not collect the data of any person under eighteen (18).
